Terms of supply
The standard conditions on which Thermlock Cold Chain Systems Pty Ltd accepts orders and delivers bodies. A signed order specification takes precedence where the two differ.
1. Quotation and order
Quotations are valid for 30 days and are based on the chassis and specification stated. A change of chassis, wheelbase or specification after order is a variation and is quoted separately before work proceeds.
2. Chassis
Where the customer supplies the chassis, it must arrive complete, registered or on a permit, and free of defects that prevent bodying. Storage of a chassis awaiting a build slot is free for 21 days and charged thereafter.
We build to the chassis manufacturer's bodybuilder guidelines. Where a customer instructs us to depart from them we will do so only in writing, and the resulting body is excluded from our structural warranty.
3. Delivery and build times
Build times quoted run from chassis arrival, not from order. We will tell you promptly if a slot moves. We are not liable for consequential loss arising from delay, including hire of a replacement vehicle or loss of a contract.
4. Payload and dimensions
Payload and internal dimensions stated in a quotation are calculated for the specification and chassis given, and are confirmed by weighbridge ticket at handover. Where the as-built figure differs materially from the quoted figure through our error, we will remedy it at our cost.
5. Refrigeration plant
We install plant specified by the customer. We do not manufacture, supply or warrant refrigeration equipment, and plant warranty claims go to its manufacturer. We take no commission on plant selection.
6. Warranty
Structure and floor are warranted for five years from handover, fit-out for two. Seals, hinges, catches and light fittings are consumable items subject to fair wear. Warranty is void where a body has been modified, over-height loaded, or repaired by a third party without authorisation.
Warranty is transferable with the vehicle. Nothing in these terms excludes rights under the Australian Consumer Law.
7. Payment
A deposit is payable on order, a progress payment on body completion and the balance before collection. Title in the body passes on payment in full. Risk passes on collection or delivery.
8. Liability
Our liability is limited, at our option, to repair, replacement or the cost of either. We are not liable for consequential loss, including loss of product, loss of profit or downtime.
9. Governing law
These terms are governed by the law of South Australia.
